1. About these Terms
These Terms of Use (“Terms”) govern your access to and use of the States of Mind microsite currently located at https://statesofmind.com/research/depression-map, together with any related survey pages, results pages, contact pages, downloadable reports, and associated content (collectively, the “Microsite” or the “Study”).
The Microsite is operated by PINK ELEPHANT, UNIPESSOAL LDA, trading as States of Mind (“States of Mind”, “we”, “us” or “our”), with a registered address at Edifício Amoreiras Square, Rua Carlos Alberto da Mota Pinto, 1070-313 Lisboa, Portugal.
By accessing the Microsite, completing the survey, submitting an email address, or otherwise using any part of the Study, you agree to be bound by these Terms, our Privacy Policy, and any additional notices shown on the Microsite. If you do not agree, you must not use the Microsite or participate in the Study.
2. What the Microsite is
The Study is an independent, research-oriented data snapshot designed to collect and present aggregated information about depression levels, anxiety indicators, and treatment or coping preferences across UK regions. The Microsite may use evidence-based screening models, including PHQ-9 and GAD-7, together with self-reported location and treatment-preference information to generate maps, charts, summaries, and written reports.
The Microsite is intended to support research, public discussion, editorial reporting, and high-level regional insight. It is not an official government or NHS service, and its outputs are not official public-health statistics.
3. Eligibility and age restriction
You must be at least 18 years old to participate in the Study.
If the Microsite states additional eligibility criteria, including any geographic restriction, residency requirement, or requirement to provide a valid UK postcode sector or similar location input, you must satisfy those criteria.
By using the Microsite, you represent and warrant that: (a) you meet all stated eligibility requirements; (b) your participation is lawful in your jurisdiction; and (c) the information you provide about your eligibility is true, accurate, and not misleading.
We may refuse, suspend, remove, or disregard any submission if we reasonably believe you are ineligible or have provided false or misleading information.
4. Research and medical disclaimer
The Great British Depression & Treatment Map, the PHQ-9 and GAD-7 screening models used in the Study, and any scores, maps, categories, rankings, percentages, treatment references, provider references, or editorial commentary made available through the Microsite are for informational and research purposes only.
Nothing on the Microsite constitutes medical advice, psychiatric advice, diagnosis, treatment, crisis intervention, or a substitute for care from a qualified healthcare professional. Participation in the Study does not create any doctor-patient, therapist-client, fiduciary, or similar professional relationship between you and States of Mind, Tanya Levinson, or any other provider referenced on or through the Microsite.
You should not start, stop, or change any medicine, therapy, or treatment plan solely on the basis of the Microsite or your Study results. Any discussion of progressive, alternative, or emerging therapies is informational only and should be pursued only under appropriate professional supervision and in accordance with applicable law.
If you are experiencing a mental health crisis or think that you or someone else may be at immediate risk, contact your GP, call NHS 111, contact Samaritans on 116 123, call local emergency services, or seek immediate assistance from an appropriately qualified professional.
5. Your participation and conduct
You agree to use the Microsite only for lawful, personal, and non-commercial purposes unless we expressly agree otherwise in writing.
When participating in the Study, you agree to:
- provide truthful, accurate, and non-misleading responses;
- submit only information that you are entitled to provide;
- avoid entering directly identifying personal data into fields intended only for anonymous or approximate information;
- comply with any instructions, warnings, and technical requirements shown on the Microsite; and
- refrain from any conduct that could distort, damage, or undermine the integrity of the Study.
You must not:
- submit fraudulent, fabricated, duplicate, or misleading entries;
- use bots, scripts, crawlers, scraping tools, or other automated means to access, monitor, or interact with the Microsite;
- interfere with the security, performance, or availability of the Microsite;
- upload malicious code or harmful content;
- impersonate any person or entity, or misrepresent your identity, age, eligibility, or affiliation;
- use the Microsite for spam, unsolicited promotion, data harvesting, or unlawful activity; or
- attempt to reverse engineer, extract, or re-identify any anonymous or aggregated data made available through the Study.
6. Survey data, optional contact data, and privacy
Participation in the Study may involve submission of anonymous survey data, such as postcode sector or other approximate location information, PHQ-9 and GAD-7 responses or scores, and treatment or coping preferences. If you choose to opt in for the final report or to enter the Consultation Draw, you may also submit your email address as contact data.
Our Privacy Policy explains how we collect, use, store, and protect this information. In summary, the Study is designed so that anonymous survey data and optional contact data are handled separately. Contact data are optional. Where an email address is collected, it is stored separately from survey data and is not intended to be linked back to your mental-health scores.
Because survey responses are designed to be anonymous, it may not be possible for us to retrieve, correct, or delete a specific survey submission after it has been submitted. Where the law requires consent, by clicking the relevant consent box and submitting your information, you expressly consent to the collection and use of the relevant data as described in the Privacy Policy.
7. Results, map outputs, and research limitations
The Study relies on self-reported information. As a result, the Microsite and any map, score, severity indicator, comparison, ranking, regional label, or report generated from the Study may reflect bias, inaccuracies, omissions, non-response effects, or methodological limitations.
All outputs are illustrative research outputs only. They should not be treated as clinical findings, definitive prevalence data, official statistics, or a complete picture of any city, region, or community.
We may update or change the methodology, thresholds, labels, categorisations, regional groupings, visualisations, editorial framing, or publication timeline at any time. We do not guarantee that the Microsite will be continuously available, error-free, comprehensive, representative, or fit for any particular purpose.
8. Consultation Draw
If the Microsite offers an optional draw for a consultation with Licensed Therapist Tanya Levinson (the “Consultation Draw”), the following terms apply unless more specific promotional terms are displayed on the entry page or campaign notice.
- Entry is free and no purchase is necessary. To enter, you must provide a valid email address through the method stated on the Microsite during the promotional period.
- Unless the Microsite states otherwise, entry is limited to one entry per eligible participant. We may disqualify incomplete, late, illegible, automated, duplicate, fraudulent, or otherwise non-compliant entries.
- The prize is one consultation with Tanya Levinson with a stated value of GBP 90, unless a different value, quantity, or format is clearly stated on the Microsite.
- By entering the Consultation Draw, you agree that we may contact you by email in connection with the draw and, if you are selected, to administer the prize.
- The prize has no cash alternative, is non-transferable, and may not be resold, exchanged, or substituted by the winner except where substitution is required by law or reasonably necessary because of circumstances outside our control.
- Delivery of the consultation is subject to Tanya Levinson's availability, intake processes, legal and ethical obligations, and independent professional discretion. Being selected as a winner does not guarantee that a therapeutic relationship will be formed or that any specific form of treatment will be provided.
- Unless the Microsite clearly states a different process, the winner will be selected at random from eligible entries within 14 days after the closing date and notified by email. If a selected winner does not respond within 7 days after the first notification attempt, we may select an alternative winner.
- To demonstrate that a valid award took place, we may publish or make available limited winner information, such as surname and county, unless the winner objects or requests that the information disclosed be reduced where the law allows. We may still be required to provide winner information to a regulator or other competent authority if lawfully requested.
- The version of these Terms and any campaign-specific draw terms that applies to your entry is the version in force at the time you enter, unless a change is required by law, regulation, or administrative necessity.
9. Intellectual property and permitted use
All rights, title, and interest in and to the Microsite and its content remain with PINK ELEPHANT, UNIPESSOAL LDA and its licensors. This includes the website design, text, branding, software, datasets, anonymised and aggregated outputs, methodology descriptions, maps, charts, graphics, reports, downloadable materials, logos, and all other content made available through the Microsite.
Except where the law permits or we expressly allow in writing, you must not reproduce, adapt, republish, sell, license, distribute, scrape, mine, index, publicly display, publicly perform, create derivative works from, or otherwise exploit the Microsite or any substantial part of its content for commercial purposes.
Media outlets and third parties may refer to or report on the Study's findings only if they provide clear and accurate attribution to “States of Mind: The Great British Depression & Treatment Map” and do not imply sponsorship, endorsement, or affiliation without our prior written permission.
Limited personal, editorial, academic, and journalistic quotation of non-substantial excerpts or screenshots may be permitted where the use is lawful, fair, accurate, and accompanied by proper attribution.
10. Third-party content, links, and providers
The Microsite may refer to or link to third-party websites, crisis resources, service providers, therapists, clinics, articles, tools, or external materials. Such references are provided for convenience, context, or information only.
Unless we expressly state otherwise, we do not own, operate, regulate, supervise, or guarantee third-party services or content, and we are not responsible for their availability, accuracy, legality, pricing, credentials, safety, marketing claims, or outcomes. References to providers or therapies do not amount to a recommendation that any treatment is suitable, lawful, or available for you.
If you choose to contact, book, or otherwise engage with any third party, you do so at your own risk and subject to that third party's own terms, policies, and professional obligations.
11. Suspension, removal, and study integrity
We may, at any time and without prior notice where reasonably necessary, restrict access to the Microsite, suspend features, remove content, disregard submissions, disqualify entries, or take any other action we reasonably consider necessary to protect the integrity, security, legality, or proper administration of the Study.
This includes circumstances where we reasonably believe there has been fraud, abuse, technical manipulation, legal risk, reputational harm, ineligible participation, or a breach of these Terms.
12. Disclaimer of warranties
The Microsite is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, representations, and conditions, whether express or implied, including any implied warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, non-infringement, or quiet enjoyment.
We do not warrant that the Microsite will be uninterrupted, secure, compatible with your device, free from bugs or harmful code, or always available at any specific time. Nothing in these Terms limits any mandatory rights you may have under applicable consumer law.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, punitive, or consequential loss or damage, or for any loss of revenue, profit, opportunity, reputation, goodwill, business, or data, arising out of or in connection with the Microsite, the Study, the Consultation Draw, or your reliance on any content, score, map, or report.
We do not exclude or limit liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above, our total aggregate liability to you arising out of or in connection with these Terms, the Microsite, or the Study will not exceed GBP 100.
14. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will post the updated version on the Microsite and update the “Last updated” date.
If you continue to use the Microsite after the revised Terms take effect, you agree to the revised Terms. If you do not agree to the revised Terms, you must stop using the Microsite.
Any material change to the Consultation Draw terms will not apply retroactively to entries already submitted unless the change is required by law, regulation, or the fair administration of the promotion.
15. Governing law and jurisdiction
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your part of the UK and may have the benefit of mandatory protections under the law of your place of residence.
If you are using the Microsite on behalf of a business, institution, or other organisation, the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
