Psychedelic Therapy Legal Landscape

Esketamine (Spravato)

Fully funded (NFZ B.147)

NFZ drug programme B.147 has funded esketamine since 2023 — free of charge (drug, visits, observation, monitoring) at ~64 contracted centers. Criteria are narrow: ages 18–75, moderate-to-severe episode, at least 2 but no more than 5 failed antidepressants, at least a second episode lasting 6+ months; bipolar, psychotic symptoms and substance-dependence history excluded. Treatment caps at 34 weeks. Unique transparency: live first-appointment waiting times for every center on the NFZ portal, and you may enrol at any center regardless of where you live.

Medical Cannabis

Legal (Rx) since 2017

Cannabis is an approved pharmaceutical raw material for pharmacy-compounded preparations (act of 7 July 2017, in force 1 Nov 2017) — any physician may prescribe on a narcotic prescription; unsubsidized, all supply imported; since Nov 2024 an in-person examination is required. Recreational: illegal (prosecutors may drop small-amount cases, Art. 62a).
