1. Introduction

These Terms of Use govern access to and use of the States of Mind website, community, educational content, mental health self-assessments and quizzes, AI Navigator, newsletters, provider-contact features and related online services made available through States of Mind.

In these Terms, “States of Mind”, “SOM”, “we”, “us” and “our” refer to Pink Elephant, Unipessoal Lda in its operation of the States of Mind platform. “Platform” means the States of Mind website and the services, content and features made available through it.

By accessing or using the Platform, creating a community account, submitting content, completing a self-assessment, using the AI Navigator, subscribing to a newsletter or submitting another form, you agree to these Terms. If you do not agree to these Terms, you must not use the relevant Platform feature.

2. Eligibility

The Platform is intended only for individuals who are at least 18 years old, or the age of legal majority in their jurisdiction if that age is higher.

By accessing or using the Platform, you represent that you satisfy this age requirement and have legal capacity to enter into these Terms.

A person who does not satisfy the age requirement must not create a community account, complete a self-assessment, use the AI Navigator, subscribe to the newsletter or otherwise submit personal data through the Platform. The current States of Mind website is expressly limited to users aged 18 or older.

3. Nature of the Platform

States of Mind is an educational and informational platform concerning mental health, wellbeing, psychedelic-related topics, research, personal experiences, practical resources and related subjects.

The Platform may provide editorial content, screening and self-assessment tools, educational recommendations, a private community, expert discussions, provider information, newsletters and AI-assisted website navigation.

States of Mind is not a healthcare provider, clinic, emergency service, crisis service, pharmacy, treatment provider or professional regulatory body.

No use of the Platform creates a doctor-patient, therapist-client, counsellor-client, pharmacist-patient, fiduciary or other professional relationship between you and States of Mind.

4. No medical advice, diagnosis or treatment

All Platform content and features are provided for general educational and informational purposes.

States of Mind does not provide medical advice, psychological advice, diagnosis, treatment, prescribing, clinical assessment, treatment eligibility decisions or individualized professional care.

Articles, screening results, AI-generated responses, educational recommendations, community discussions, provider information and other Platform materials must not be treated as a substitute for advice, diagnosis or treatment from a qualified healthcare professional.

You should consult an appropriately qualified professional before making decisions concerning your physical or mental health, medication, treatment, therapy, substance use or participation in psychedelic-assisted or other progressive mental health services.

The States of Mind website consistently describes its content and self-assessment tools as educational rather than diagnostic and directs users to seek qualified professional care where appropriate.

5. Emergency and crisis situations

States of Mind is not an emergency or crisis-response service.

You must not rely on the Platform, community, assessments, AI Navigator, email, direct messages or other Platform communications for emergency assistance, crisis intervention or real-time monitoring.

If you believe that you or another person may be in immediate danger, may be at risk of self-harm, or requires urgent medical or mental health assistance, you should contact the applicable local emergency service, crisis service, mental health helpline or qualified healthcare professional without delay.

Unless expressly stated otherwise in a particular feature, you should not assume that assessment responses, community content, direct messages or AI Navigator interactions are monitored in real time or will cause States of Mind to contact emergency services.

6. Mental health content and psychedelic-related information

The Platform may discuss mental health conditions, psychedelic substances, ketamine therapy, cannabis, microdosing, harm reduction, integration, progressive treatments and related legal or scientific topics.

Such content is educational only. It does not constitute encouragement, authorization or instruction to acquire, possess, manufacture, supply or use any substance unlawfully.

Laws concerning psychedelics, controlled substances, medicines, therapy and healthcare services vary by jurisdiction. You are responsible for understanding and complying with the laws that apply to you.

States of Mind does not guarantee that a treatment, substance, provider, clinic, retreat or service described on the Platform is lawful, available, authorized, clinically appropriate or suitable for you.

7. Editorial content

States of Mind aims to publish accurate, balanced and evidence-informed content. Content may include articles, interviews, guides, research summaries, expert commentary, personal stories and other editorial materials.

Some content may be reviewed by qualified professionals or subject-matter experts. Such review does not convert the content into individual medical advice or guarantee that it is complete, error-free or suitable for every user.

Scientific, medical and legal knowledge develops over time. Content may become outdated, incomplete or superseded by later evidence, professional guidance or law.

You should verify information relevant to an important health, treatment or legal decision with an appropriately qualified professional.

The States of Mind Editorial Policy describes the Platform’s editorial standards, sourcing and review approach.

8. Self-assessments and educational quizzes

States of Mind may offer optional mental health self-assessments, symptom screeners, readiness tools and educational quizzes.

These tools may ask about mood, anxiety, attention, trauma, sleep, energy, substance use, sexual wellbeing, treatment interests, psychedelic-related interests or other health-related matters. The tools may calculate a score, place responses into an educational severity band or provide general suggested next steps.

Self-assessments are screening and educational tools only. They do not provide a medical diagnosis, clinical assessment, treatment recommendation or professional determination of eligibility for any treatment.

Any wording such as “candidate”, “readiness”, “starter”, “eligibility”, “severity” or similar terminology used within a tool must be understood as an educational orientation only and not as a clinical or legal determination.

Results depend on the accuracy and completeness of the answers submitted. Results may be incomplete, unsuitable or inaccurate and may differ if the assessment is repeated.

You must not use a self-assessment result as the sole basis for starting, stopping or changing medication, therapy, medical treatment, substance use or any other health-related course of action.

The current website offers screening tools concerning mood, anxiety, trauma, attention and other mental health subjects, while expressly stating that results are screening indicators and not diagnoses.

9. Assessment consent and sensitive information

Some self-assessments process health or other sensitive information.

Before such data is processed, States of Mind may require you to provide a separate consent or explicit consent through the applicable assessment flow.

Acceptance of these Terms does not replace any separate consent required under data-protection law.

If you do not provide the required consent, you must not use the relevant assessment feature. If you withdraw consent, future processing based on that consent will stop in accordance with the Privacy Policy, although withdrawal does not affect processing that occurred lawfully before withdrawal.

You should not submit personal information about another person in an assessment.

10. Assessment recommendations and OpenAI

States of Mind may calculate assessment results within its own systems and use the OpenAI API to generate personalized educational text based on selected assessment information.

The information sent for this purpose may include assessment-derived information such as age or age range, sex or gender where relevant, country, assessment outcome and related response context.

OpenAI-generated recommendations may be inaccurate, incomplete, unsuitable or inconsistent. They are educational outputs only and must not be treated as medical advice, diagnosis, treatment guidance or professional evaluation.

The use of OpenAI and the processing of assessment data are described in the Privacy Policy and the relevant assessment consent notice.

11. AI Navigator

The AI Navigator is an optional AI-assisted feature intended to help users identify relevant States of Mind website content.

The AI Navigator may ask questions about what you are seeking and may use the information you enter to recommend articles, tools, screenings or other areas of the Platform. The current website presents the AI Navigator as a feature that recommends a starting path based on the user’s stated interests.

The AI Navigator is not a healthcare professional, clinical decision-support tool, diagnostic tool, treatment recommender, crisis service or emergency service.

AI Navigator responses may be generated through the OpenAI API and may be inaccurate, incomplete, outdated, repetitive or unsuitable.

You must not rely on an AI Navigator response for a medical, therapeutic, medication, emergency, legal or safety-critical decision.

You should not submit information about another person or any information that is unnecessary for identifying relevant website content.

Where an AI Navigator interaction contains health or other special-category data, separate explicit consent may be required before that information is processed. Acceptance of these Terms does not replace that consent.

12. No solely automated significant decisions

States of Mind does not use the self-assessments or AI Navigator to make solely automated decisions that produce legal effects or similarly significant effects concerning users.

Assessment scores and AI Navigator outputs do not determine access to healthcare, treatment, employment, insurance, credit, education, public benefits or another essential service.

13. Community accounts

States of Mind may offer access to a private community through Circle.

To use community features, you may be required to create or access a community account using an email-based magic link or another authentication method made available through the Platform.

You are responsible for maintaining the security of your email account, device and authentication credentials. You must not allow another person to use your community account or impersonate another person.

You must notify States of Mind promptly if you believe your account has been compromised or used without authorization.

Where a third-party sign-in option is made available, your use of that option may also be governed by the relevant third party’s terms and privacy information.

14. Community participation

The community may allow members to create posts, comments and reactions, exchange direct messages, join chats, participate in live events or AMA sessions, upload content where enabled, and communicate with other members, hosts or invited experts.

Community content is provided by members and does not necessarily reflect the views of States of Mind.

A member, host, expert or other community participant may not be a healthcare professional. Even where a participant is a professional, community communications do not necessarily create a professional relationship or constitute personalized professional advice.

States of Mind does not guarantee that another community member, host or expert will respond, that any response will be accurate, or that community participation will produce a particular outcome.

The website describes the community as a private space for discussions, expert sessions, live webinars and member interaction.

15. Community anonymity

A feature may allow a member to appear under a display name, pseudonym or anonymous label to other community members.

Such presentation does not necessarily make the member anonymous to States of Mind, Circle or authorized administrators. Account, technical and moderation information may remain linked to the member for account operation, security, legal compliance and enforcement of these Terms.

You must not attempt to identify, expose or publish the identity of another member who participates anonymously or pseudonymously.

16. Community health disclosures

Members may voluntarily disclose health, mental health, treatment, psychedelic-related or other special-category information in community content.

Where legally required, States of Mind will request separate explicit consent before processing such content. Membership must not be understood as requiring a member to disclose health information.

You should disclose only information that you are comfortable sharing with the intended audience within the community.

You must not disclose another person’s health information, identity, private messages or confidential information unless you have a valid lawful basis and authority to do so.

17. Community conduct

You must use the community respectfully, lawfully and in a manner consistent with the safety and integrity of other members.

You must not harass, threaten, intimidate, exploit or discriminate against another person. You must not publish hateful, abusive, defamatory, obscene, fraudulent or unlawfully discriminatory content.

You must not encourage self-harm, suicide, violence, dangerous behavior, unlawful substance activity or the misuse of medication.

You must not impersonate a healthcare professional or falsely claim qualifications, licenses or expertise.

You must not use the community to prescribe treatment, diagnose another member, provide unlawful medical services, sell controlled substances, arrange unlawful substance transactions, promote unsafe retreats or solicit vulnerable members for improper commercial or personal purposes.

You must not publish personal data, private communications, confidential information or identifiable health information concerning another person without lawful authority.

You must not upload malware, attempt to gain unauthorized access, interfere with the Platform, collect other members’ data without permission, scrape community content or use community content to train an artificial-intelligence system without written authorization.

18. Moderation and enforcement

States of Mind may review, restrict, hide, remove or preserve community content where reasonably necessary to enforce these Terms, protect members, investigate reports, comply with law, preserve evidence, maintain security or protect platform integrity.

States of Mind may warn, restrict, suspend or terminate a community account where it reasonably believes that these Terms have been breached or that continued access creates a legal, security, safety or platform-integrity risk.

States of Mind is not required to monitor every post, message, event or interaction and does not guarantee that harmful, inaccurate or unlawful content will be identified immediately.

Where appropriate, a member may be given an opportunity to respond to a moderation concern. States of Mind may take immediate interim action where necessary to protect users or the Platform.

19. Direct messages

Direct messages are intended for communication between the relevant participants, but they are processed through the community platform and are not guaranteed to be confidential from the platform provider or authorized States of Mind personnel.

Authorized access may occur where necessary for security, moderation, legal compliance, investigation of a report or operation of the messaging function.

You must not use direct messages for harassment, unlawful solicitation, unauthorized medical practice, controlled-substance transactions or disclosure of another person’s confidential information.

20. User content

“User Content” means posts, comments, messages, reactions, profile information, images, attachments, event contributions, assessment inputs, AI Navigator messages, feedback and other material submitted through the Platform.

You retain any ownership rights you hold in User Content.

You grant Pink Elephant, Unipessoal Lda a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display and make User Content available only to the extent necessary to provide the feature through which it was submitted, operate and secure the Platform, moderate content, investigate reports, comply with legal obligations and exercise or defend legal claims.

This license does not give States of Mind the right to sell your health information or use private community content for unrelated advertising.

You represent that you have the right to submit the User Content and that its submission does not violate applicable law, confidentiality obligations, intellectual-property rights, privacy rights or other rights of another person.

21. Provider information and contact requests

The Platform may display information about third-party providers or permit users to request contact with a provider.

Provider information is supplied for informational and discovery purposes. The presence of a provider on the Platform does not constitute a guarantee, medical endorsement, recommendation or assurance that the provider is suitable for a particular person.

Where you submit a provider-contact request, you authorize States of Mind to use the details entered in the form to contact the selected provider on your behalf or transmit the request to the provider, as described in the applicable notice.

States of Mind does not guarantee that the provider will respond, accept you as a client, be available, be appropriately licensed in your jurisdiction, offer a suitable service or achieve a particular outcome.

Any relationship or contract with a provider is between you and that provider. States of Mind is not a party to the provider-client relationship and is not responsible for the provider’s advice, services, conduct, fees, availability or compliance with professional duties.

22. Newsletter

A user may subscribe to the States of Mind newsletter and educational updates.

Newsletter subscription is optional and requires consent. A subscriber may withdraw consent at any time through the unsubscribe mechanism included in the email or through another method described in the Privacy Policy.

Newsletter content is educational and may include Platform updates, articles, events or other communications consistent with the subscription notice.

23. Third-party links and services

The Platform may link to websites, providers, communities, research sources, social-media services and other third-party resources.

Third-party services are governed by their own terms and privacy policies. States of Mind does not control and is not responsible for third-party content, security, availability, legality, privacy practices or services.

A link or reference does not necessarily constitute endorsement.

The Platform also relies on service providers including Circle, OpenAI, Brevo, Amplitude, Google Analytics, DigitalOcean and Cloudflare.

24. Analytics and cookies

States of Mind may use analytics and Session Replay technologies only in accordance with the Privacy Policy, Cookie Policy and applicable consent choices.

Non-essential analytics technologies must not be activated before the required consent is provided.

Refusal or withdrawal of analytics consent does not prevent access to core website content, although some preferences or measurements may no longer be available.

25. Intellectual property

The Platform, including its text, graphics, layout, branding, logos, software, databases, screening presentation, editorial materials and other content, is owned by Pink Elephant, Unipessoal Lda or its licensors and is protected by applicable intellectual-property laws.

Third-party screening instruments, research materials, trademarks and other third-party content remain the property of their respective owners.

Subject to these Terms, States of Mind grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Platform for personal, lawful and non-commercial purposes.

You must not reproduce, distribute, modify, republish, sell, license, scrape, systematically extract, reverse engineer or create derivative works from Platform content without prior written permission, except where mandatory law permits the activity.

26. Acceptable use of the Platform

You must not use the Platform unlawfully or in a way that interferes with its operation, security or availability.

You must not attempt to access another person’s account or restricted areas, bypass access controls, probe vulnerabilities, transmit malicious code, overwhelm infrastructure, falsify consent, manipulate assessment results, submit fraudulent forms, impersonate another person or use automated tools to collect Platform data without written permission.

You must not use Platform content or services to facilitate unlawful medical practice, unlawful controlled-substance activity, fraud, exploitation, harassment or harm.

27. Feedback and submissions

If you submit comments, corrections, suggestions or feedback concerning the Platform, you authorize States of Mind to review and use that feedback for operation and improvement of the Platform without payment, provided that personal data is handled in accordance with the Privacy Policy.

Submission of an editorial proposal, provider enquiry, review-board application or other professional enquiry does not guarantee acceptance, publication, appointment, partnership or response.

Separate written terms may apply if States of Mind accepts editorial, professional or commercial work from you.

28. Availability and changes

States of Mind may change, update, suspend or discontinue any part of the Platform where reasonably necessary for legal, technical, editorial, security, operational or business reasons.

States of Mind does not guarantee that the Platform or any feature will always be available, uninterrupted, secure or error-free.

Features, assessment content, recommendation logic, community functionality and AI Navigator outputs may change over time.

Where a change materially affects the processing of personal data or a consent previously given, States of Mind will provide the notice or obtain the consent required by applicable law.

29. Account suspension and termination

You may stop using the Platform at any time and may request deletion of a community account in accordance with the Privacy Policy.

States of Mind may suspend or terminate access where you breach these Terms, misuse the Platform, create a security or safety risk, infringe another person’s rights, engage in unlawful conduct or fail to comply with reasonable moderation instructions.

Termination does not affect provisions that by their nature should continue, including intellectual-property rights, content licenses, disclaimers, liability provisions, governing law and records lawfully retained for security, legal or dispute purposes.

30. Disclaimer of warranties

The Platform is provided on an “as is” and “as available” basis, subject to any rights or warranties that cannot lawfully be excluded.

States of Mind does not warrant that Platform content, assessments, scores, AI outputs, community content, provider information or recommendations will be complete, accurate, current, suitable or free from error.

States of Mind does not warrant that use of the Platform will produce a particular health, wellbeing, educational, professional or other outcome.

Nothing in this section excludes any statutory right or warranty that cannot lawfully be excluded.

31. Limitation of liability

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by unlawful conduct, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law, States of Mind is not responsible for indirect or consequential loss arising from use of the Platform, including loss arising from reliance on educational content, assessment results, AI-generated output, community content, third-party services or provider information.

States of Mind remains responsible for direct loss caused by its breach of these Terms to the extent required by applicable law.

You remain responsible for decisions you make concerning treatment, healthcare, substance use, provider engagement or other actions based on information obtained through the Platform.

32. Privacy

Personal data is processed in accordance with the States of Mind Privacy Policy.

The Privacy Policy explains the categories of data processed, purposes, legal bases, processors, international transfers, retention periods and data-subject rights.

Acceptance of these Terms is not consent to processing that requires separate consent or explicit consent.

Where consent is required for analytics, newsletter communications, community health disclosures, assessments or AI Navigator health data, the applicable consent must be obtained separately.

33. Changes to these Terms

States of Mind may amend these Terms where necessary to reflect changes to the Platform, law, security requirements, business operations or service providers.

The revised Terms will state the effective or last-updated date.

Where a change materially affects registered users’ rights or obligations, States of Mind will provide reasonable notice. Where applicable law requires affirmative acceptance of a change, States of Mind will request it.

If you do not agree to the revised Terms, you must stop using the affected Platform feature.

34. Governing law and jurisdiction

These Terms are governed by the laws of Portugal.

If you are a consumer, nothing in these Terms deprives you of mandatory protections available under the law of your habitual residence.

Subject to mandatory consumer-law jurisdiction, disputes arising from these Terms or use of the Platform are subject to the competent courts of Portugal.

35. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect.

The affected provision will be interpreted or limited to the minimum extent necessary to make it valid and enforceable where permitted by law.

36. No waiver

A failure or delay by States of Mind to enforce a provision of these Terms does not waive the right to enforce that provision later.

37. Entire agreement

These Terms, together with any feature-specific terms, community rules or notices expressly incorporated into them, form the agreement governing use of the Platform.

The Privacy Policy, Cookie Policy and consent notices govern personal-data processing and should be read alongside these Terms.
