1. Introduction and Acceptance

These Terms of Use (the “Terms”) govern your access to and use of the States of Mind website at statesofmind.com and any associated content, tools, community and features (together, the “Service”). The Service is operated by Pink Elephant, Unipessoal Lda, a company registered in Portugal under company number (NIPC) 519056582, with its registered address at Edifício Amoreiras Square, Rua Carlos Alberto da Mota Pinto, no. 17, second floor, 1070-313 Lisboa, Portugal (“Pink Elephant”, “States of Mind”, “we”, “us” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to them, you should not access or use the Service. Our Privacy Notice and Cookie Policy, which explain how we process personal data in connection with the Service, are incorporated into these Terms by reference.

2. The Service

States of Mind is a media and educational platform dedicated to psychedelic care. Through the Service, we publish articles, expert insights and research summaries, a podcast, substance guides and other educational resources, and we offer optional tools, including self-assessments and screenings and an AI-assisted navigation feature (“AI Navigator”), a members’ community, and a newsletter.

The Service is co-created with industry professionals and is intended to support open, evidence-based conversation about psychedelic care and to help destigmatize it. It is not a healthcare provider, and using the Service does not create a doctor-patient, therapist-client or other professional-client relationship between you and Pink Elephant or any contributor, expert or moderator involved in the Service.

3. Not Medical Advice, Not a Crisis Service

The Service, including all articles, podcast episodes, substance guides, self-assessments, screenings and AI Navigator outputs, is provided for general educational and informational purposes only. It is not a substitute for professional medical, psychological or psychiatric advice, diagnosis or treatment, and you should always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical or mental health condition. Never disregard professional medical advice, or delay seeking it, because of something you have read, completed or received through the Service.

Our self-assessments and screenings are optional and are intended to give you general, evidence-based information about yourself. They do not diagnose any condition, do not constitute a clinical screening in the medical sense, do not recommend any particular treatment, and do not decide your eligibility for any treatment. Where a personalized recommendation or response is generated for you, including through our AI Navigator, it is produced with the assistance of an artificial intelligence model, may not be accurate, complete or applicable to your individual circumstances, and should not be relied upon in place of professional advice.

The Service is not an emergency or crisis service and is not monitored for emergencies. If you are in crisis, experiencing thoughts of suicide or self-harm, or facing a medical emergency, please contact your local emergency services number or an appropriate crisis helpline in your country, or go to your nearest emergency department, without delay. Do not use the Service, including the self-assessments, screenings or AI Navigator, in place of emergency care.

4. Eligibility

You must be at least 18 years old to use the Service. By accessing or using the Service, you represent and warrant that you meet this requirement. The Service is not directed at children, and we ask anyone who believes a child is using the Service to contact us at privacy@statesofmind.com.

5. Accounts and Community Registration

Certain parts of the Service, including our community, require you to register for an account. Community accounts are provided through our third-party community platform and may be created directly or by signing in through a third-party provider such as Google, where we make this available. You agree to provide accurate information when registering, to keep your login credentials confidential, and to notify us if you believe your account has been accessed without your authorization.

We may suspend or terminate your account, in whole or in part, where we reasonably consider this necessary to comply with these Terms, to protect the Service or other users, or to comply with the law.

6. Community Conduct

Our community exists to support open, respectful conversation about psychedelic care, including live events, expert question-and-answer sessions and discussion among members. When participating, you must not post, send or otherwise disclose health information or other personal data about another identifiable individual unless you have a proper basis for doing so and it is genuinely necessary. You remain responsible for any content you choose to share about yourself or others.

We may, at our discretion, remove content, restrict participation or suspend or terminate access to the community where we reasonably consider that a member’s conduct or content breaches these Terms, our community guidelines, applicable law, or otherwise threatens the safety, rights or wellbeing of another person. We moderate the community on a reasonable-efforts basis but do not undertake to review every item of content before or after it is posted.

7. User-Generated Content

You retain ownership of the content you submit to the Service (“Your Content”). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and distribute it for the purposes of operating and promoting the Service, including making it visible to other members or the public where the relevant feature is designed to do so, and moderating it in accordance with these Terms. You represent that you have the necessary rights to submit Your Content and that doing so does not infringe the rights of any third party or breach applicable law.

8. Self-Assessments, Screenings and AI Navigator

Use of our self-assessments, screenings and AI Navigator is optional and subject to your consent as described in our Privacy Notice. You may decline to use these features, or stop using them, at any time. These features rely in part on third-party artificial intelligence technology. While we take reasonable steps to structure the underlying prompts responsibly, we do not warrant that any output is accurate, complete, current or suitable for your particular situation, and you should exercise your own judgment, and consult a qualified professional, before acting on it.

9. Newsletter

If you subscribe to our newsletter, we will send you the communications you have agreed to receive. You may unsubscribe at any time using the link provided in each communication or by contacting us directly, as described in our Privacy Notice.

10. Editorial Content and Contributions

Articles, expert commentary, contributor pieces and other editorial content published through the Service reflect the views of their respective authors, which are not necessarily our views and do not constitute our endorsement of any particular treatment, provider, product or substance. Our editorial standards, review process and contributor standards, published separately on the Service, form part of our approach to editorial content and are available for reference alongside these Terms.

11. Intellectual Property

Except for Your Content, the Service and its content, including text, graphics, logos, the States of Mind name and branding, and the design and organization of the website, are owned by or licensed to Pink Elephant and are protected by intellectual property laws. You may access and use the Service for your own personal, non-commercial use.

You may not reproduce, distribute, publicly perform or display, or create derivative works from, any part of the Service, or use automated means to extract content from it, including for the purpose of training or fine-tuning a machine-learning or artificial intelligence model, without our prior written consent.

12. Third-Party Links and Services

The Service may link to, integrate with, or rely on services operated by third parties, including sign-in providers, our community platform, our podcast hosting provider, and social media platforms. We do not control these third-party services and are not responsible for their content, accuracy, or practices, including their processing of your personal data, which is governed by their own terms and privacy notices.

13. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, completeness, reliability, availability or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, secure or error-free. Nothing in this section limits any right or remedy that applicable law does not permit us to exclude, including, where applicable, statutory rights available to you as a consumer.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Pink Elephant shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or goodwill, arising out of or in connection with your use of, or inability to use, the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including any mandatory consumer protection rights available to you under the law of the country in which you are habitually resident.

15. Indemnification

You agree to indemnify and hold Pink Elephant harmless from and against any claims, liabilities, damages and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service, save to the extent such claims, liabilities, damages or expenses arise from our own breach of these Terms or applicable law.

16. Suspension and Termination

We may suspend or terminate your access to all or part of the Service at any time, with or without notice, where we reasonably consider this necessary for the reasons described in these Terms. You may stop using the Service, and request deletion of your account, at any time, as described in our Privacy Notice.

Provisions of these Terms that by their nature should survive termination, including those relating to intellectual property, disclaimers, limitation of liability and governing law, will survive.

17. Governing Law and Jurisdiction

These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of Portugal, without regard to its conflict of laws principles, and, subject to the following sentence, the courts of Lisbon, Portugal will have exclusive jurisdiction over any such dispute.

If you are using the Service as a consumer habitually resident in another European Union member state, this choice of law and jurisdiction is without prejudice to any mandatory protections available to you, and to any right you may have to bring or defend proceedings before the courts of your own country, under applicable EU consumer protection and private international law.

18. Complaints

If you have a complaint about the Service, you are welcome to contact us at privacy@statesofmind.com so that we can try to resolve it directly, although you are not required to do so before exercising any right described below. If your complaint concerns our processing of personal data, you have the independent right to lodge a complaint with the CNPD, our lead supervisory authority, or with the supervisory authority of the EU member state in which you live, work, or where the alleged infringement took place. Consumers may also have the right to refer certain disputes to a competent alternative dispute resolution entity recognized under the law of their country of residence.

19. Changes to These Terms

We may update these Terms from time to time, including to reflect changes in the Service or the law. We will post the updated version on our website with a revised effective date and, where the changes are material, we will take reasonable additional steps to bring them to your attention. Your continued use of the Service after an update takes effect constitutes your acceptance of the updated Terms.
